On 4 November 2016 the Circuit Court in Warsaw admitted for examination in class proceedings an action for payment against Skandia (the current company name is Vienna Life Towarzystwo Ubezpieczeń na Życie S.A. Vienna Insurance Group). The Court’s ruling means that the stage of examining the admissibility of the claim by the court of the first instance has ended successfully.

Moreover, the Circuit Court held that there were no grounds for Skandia to demand a deposit to secure the costs of the trial.

The claim concerns unit-linked life insurance policies terminated by consumers. Group members demand that Skandia returned the sums collected in relation to terminating life insurance agreements. Such sums were collected as a liquidation fee or Skandia did not give them any name, paying out to the consumers only a so-called policy surrender value. The claimant acting for the benefit of the consumers – the group members is the Municipal Consumer Ombudsman in Szczecin – Ms. Longina Kaczmarek, represented by legal counsel from our Law Office.

The decision is not final and valid, the defendant Skandia may file an appeal.
